Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of Enclosed Vehicle Transport (“EVT”), a booking platform accessible through both our website and mobile app (collectively referred to as the “Platform”). The Platform is owned and operated by PRECISION TRANSFER SOLUTIONS PTY LTD (“Company”). By accessing and using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
1. Eligibility
You must be at least 18 years old and a resident of Australia to use the Platform. You must also have the legal capacity to enter contracts.
2. Vehicle Information and Bookings
· You are responsible for ensuring the accuracy and completeness of the vehicle information you provide through the Platform, including make, model, year, dimensions, any special considerations, and accurate descriptions of any damage.
· If vehicle dimensions are not correctly filled when making a booking and we cannot pick up the vehicle, 50% of the booking fee is retained to cover costs expended.
· Bookings are confirmed upon payment completion. The Company reserves the right to cancel bookings in its sole discretion for any reason, including non-payment, inaccurate vehicle information, or violation of these Terms.
3. Data Collection and Use
· The Company collects data necessary for booking purposes, including your name, contact information, vehicle details, booking history, pickup/drop-off locations, and IP address. This data is used to facilitate bookings, provide customer support, and improve the Platform experience.
· The Company may also collect device information such as GPS location data to enhance security, personalize the App experience, and help to support application features (with your consent).
· Your data will not be shared with third parties for marketing purposes without your consent. However, the Company may be required to disclose your data if legally compelled, for fraud prevention purposes, or to share vehicle location data with the transport provider for operational purposes (with your consent).
· You may access, update, or delete your data through the Platform or by contacting the Company.
4. Intellectual Property
All content and design of the Platform are protected by copyright, trademark, and other intellectual property laws. You may not use any Platform content or design without the Company’s express written permission.
5. Disclaimer of Warranties
The Platform and transportation services are provided “as is” without any warranties, express or implied. The Company disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, and safe delivery of vehicles.
6. Limitation of Liability
The Company will not be liable for any damages arising from your use of the Platform or transportation services, including direct, indirect, incidental, consequential, and punitive damages. This includes, but is not limited to, damage to vehicles, delays, loss of use, or personal injury.
7. Termination
The Company may terminate your access to the Platform at any time and for any reason, without notice.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia.
9. Force Majeure
The Company shall not be liable for any delay or failure to perform its obligations under these Terms due to any cause beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, or natural disasters.
10. Entire Agreement
These Terms constitute the entire agreement between you and the Company regarding your use of the Platform.
11. Amendments
The Company may amend these Terms at any time by posting the amended Terms on the Platform. Your continued use of the Platform after the amended Terms are posted constitutes your acceptance of the amended Terms.
